‘Odor’ Case Goes To Trial Tuesday

The now widely known “odor” suit if Paul Hinz vs. the Crown Willamette Paper company, in which the plaintiff seeks $71,000 damages for alleged injuries to his business, his hotel building and his throat by kraft mill fumes, will go to trial Tuesday morning at 9 o’clock. The initial procedure, which probably will consume the first session, will be the selection of a jury.

O. F. Johnson, former president of the First National bank, and now a California resident, will probably be one of the star witnesses for the defendant, it was learned from an authoritative source this week. In a reply to a defendant allegation last spring Mr. Hinz charged that Mr. Johnson induced him by false representations to sign a petition waiving any claim against the paper company if the kraft mill should be brought here. He did not read the document because he didn’t have his glasses handy, Mr. Hinz further declared, alleging that he relied upon Mr. Johnson’s representations that the fumes would not be injurious and that the mill would erect a tall stack to carry away the fumes.
